The companies B E M SIGNATURE REALESTATE L.L.C., Register No. 2529912, registered office in Business Bay, Dubai, UAE and DubaiReality.cz, s.r.o., ID No. 211 85 531, registered office Peroutkova 531/81, Jinonice, 158 00 Prague 5 (registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 397883) (“the Companies”), declare that they collect and process personal data in accordance with all applicable laws of the United Arab Emirates, the Czech Republic and the EU, particularly Regulation (EU) No. 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR).

The Companies collect and process PD in connection with its business activities, primarily the mediation of purchase and sale of real estate in the UAE and related services. The Companies are entitled/obliged to process PD for the following reasons:
- Processing is necessary for performance of a contract to which the data subject is a party,
- processing is necessary for compliance with a legal obligation applicable to B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o.,
- processing is necessary for the legitimate interests pursued by B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o.,
- the data subject has given consent to process their PD for one or more specific purposes.
II. SCOPE OF PERSONAL DATA PROCESSED
In connection with the activities of the Companies and with respect to the purpose, category of PD processed, category of PD recipients, and the duration of processing, the Companies distinguish the following specified persons/data subjects whose PD is collected and further processed. II.I. Client Contracting Party
A "Contractual Party" Client is an individual who has completed, is currently completing, or intends to complete a business transaction via B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o., such as the purchase or sale of real estate.
Purpose of PD processing
- Successful completion of a business transaction (e.g., purchase/sale of real estate),
- Contract conclusion with the data subject,
- Fulfillment of legal obligations, such as property registration, payment of statutory fees, etc.
- Keeping records of contractual and related documents for the necessary period to protect contractual parties, such as warranty claims, rental obligations, etc.
- Processing and sending further commercial offers to the "Contractual Party" Client.

- Other PD necessary for processing purposes, as applicable

Duration of PD processing
The Companies are authorized to process PD provided by the "Contractual Party" Client for the necessary period to protect participants in contractual relationships.
The specific date for PD deletion from the Companies databases is May 24 of the year following the expiry of 10 years from the completion of the business transaction.
If, concurrently with the main transaction, additional contracts (e.g., rental contracts) are concluded whose performance continues beyond May 24 of the year following 10 years after the main transaction, The Companies are authorized to process PD of the "Contractual Party" Client for 5 years after termination of these contracts.
II.II. Prospective Client
A "Prospective Client" is an individual who has expressed interest in conducting a business transaction via B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o., such as property purchase or sale. Typically, these individuals seek more information about properties, transaction conditions, and of the Companie’s services. It also includes individuals requesting property viewings and facilitating meetings with future contractual counterparts.
Purpose of PD processing for Prospective Clients:
- Preparing and sending commercial offers to Prospective Clients.
- Preparing informational materials regarding properties, real estate market conditions, transaction details, etc.
- Organization of personal property viewings.
- Facilitating contact with future contractual parties or their representatives.
- Facilitating contact with additional individuals crucial for the Prospective Client's decision regarding a future business transaction (e.g., attorney, tax advisor).
- Other activities based mainly on the active request of the Prospective Client.
Categories of PD involved:
- Name and surname

Note: In some cases, when a Prospective Client requests a property viewing or a meeting with a representative of the future contractual party, B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o. requests the Prospective Client to sign a so-called Letter of Interest, specifying time, place, and conditions for the viewing or meeting. The Letter of Interest includes:
- Name and surname
- Date of birth
- Permanent residence

Recipients of PD:
- Employees and individuals authorized by the PD Controller, necessary for processing purposes
- Business partner of B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o. (e.g., seller/buyer of property, their representatives)
- Company arranging rental of the property
- Attorney’s office
- Notary
- Tax advisor
- Mortgage advisor
- IT service providers
- Other relevant entities for PD processing purposes
Duration of PD processing
B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o. is authorized to process the Prospective Client’s PD as long as there is presumed interest in cooperation. This period is set at 10 years from the date the Prospective Client expressed interest.
For a Prospective Client who has attended (personally or through a representative) a property viewing or meeting with a representative of a potential contractual party via B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o., PD processing duration is set to 10 years from the viewing or meeting date.
The specific date for PD deletion from B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o.’s database is May 24 of the year following the expiry of 10 years from the above-specified date.
II.III. Subscriber of email newslette
An "Email Newsletter Subscriber" is an individual actively subscribing to the B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o. email newsletter.
Purpose of PD processing:
- Sending commercial offers by B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o.
Categories of PD involved:
- Email address of the data subject.
Recipients of PD:
- Employees and individuals authorized by the PD Controller, necessary for processing purposes.
- IT service providers.
Duration of PD processing
B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o. is authorized to process the subscriber's PD for 10 years from the Subscriber's registration date or the last consent given. For job applicants, B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o. collects and processes only PD voluntarily provided by the applicant (usually in the form of a CV). B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o. processes PD of some applicants for 3 years from the date of receipt by B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o. for potential future contact purposes.

IV. SECURITY AND HANDLING OF PERSONAL DATA
B E M SIGNATURE REALESTATE L.L.C and DubaiReality.cz, s.r.o. collect and process information and documents containing PD in both paper and electronic form. Access to PD is exclusively granted to authorized persons. B E M SIGNATURE REALESTATE L.L.C and DubaiReality.cz, s.r.o. handle PD securely, protecting it against unauthorized or unlawful processing, loss, destruction, or damage.
B E M SIGNATURE REALESTATE L.L.C and DubaiReality.cz, s.r.o. have implemented internal security guidelines and personal data protection policies. The purpose of these guidelines is to define and regularly update PD processing rules within the companies according to Article 32 GDPR and to regulate data subject rights to access PD as per Article 15 GDPR, and notification of PD breaches as per Articles 33 and 34 GDPR.
V. PERSONAL DATA PROCESSORS
Personal data is directly processed by the Controller (DubaiReality.cz s.r.o.). The Controller may delegate PD processing to another entity, such as IT service providers, law firms, accountants, etc. The Controller carefully selects processors and sets conditions to ensure the protection of data subject rights. By delegating to processors, the Controller does not relinquish responsibility for PD processing.
VI. TRANSFER OF PD ABROAD
Within EU and EEA member states, the free movement of PD cannot be restricted. More information about PD transfers abroad is available HERE.
VII. INFORMATION OBLIGATION OF THE CONTROLLER AND DATA SUBJECT RIGHTS
Data subjects (individuals whose PD is collected and processed by B E M SIGNATURE REALESTATE L.L.C and/or DubaiReality.cz, s.r.o.) have the right to be informed about PD processing. Data subjects have the following rights:
a) Right of access to personal data;
b) right to rectification;
c) right to erasure ("right to be forgotten");
d) right to restriction of data processing;
e) right to object to data processing; and
f) right to lodge a complaint regarding personal data processing

Right to object enables the data subject to oppose personal data processing conducted for direct marketing purposes or based on legitimate interests. Upon objection to direct marketing, the subject's data will no longer be processed for these purposes.
